Couple divorced in 2009 and filing joint for 2008. Husband moved to AZ in Oct of 2008. Wife stayed in MN. I see AZ is a community property state. From the instructions it appears I can file a Joint AZ. return using AZ part year.

Question is, for the period 10-16 to 12-31 2008 when husband was an AZ resident do I have to factor in any of the wifes income from MN for that same period being as it is a joint return. I am not familiar with handling community property states. The instructions also say that if the couple files MFS for AZ (if jointly on Federal) they must report income using the community property laws. But if jointly hopefully it is fine to just report the husbands income for the above period.

There was a question like this a couple of months ago. Use the yellow box to the left. Plus Arizona has an individual tax ruling regarding this. ITR 93-20.

Thanks .. That AZ ruling appears to deal strictly with couples that file separate AZ returns. I was just wondering if anything in particular would apply if they file a joint AZ return. Husband resident from 10-16-08 .. wife never a resident.

According to Arizona law the wife would be entitled to half of the income earned by the husband, and the husband would be entitled to half the income of the wife.

When filing the AZ part year return. The only income that needs to be reported on the return is the income for the husband for the time he was a resident in Arizona and any other income with a source originating in AZ.

Arizona is a community Property State. MN is not. If they were separated at the time he moved to Arizona none of the Arizona income would be community property. His income during the period of residency is Arizona taxable. Her income is not taxable in Arizona. He would be filing as a part year resident. Her portion of 2008 income would not be reported on the Arizona return as she was a non-resident.

(I have over 50 years experience as an Arizona tax man.)
