Husband and Wife were separated in 2008. I filed husbands return for 2008 as married filing separately based on his knowledge that his wife had already filed using the same status. Turns out that his wife apparently didn't file at all yet and wants to still file married filing jointly for 2008.

Is it best to amend the husbands return, change the filing status back to married/joint and add the wife to the return? OR, file the wife as married/separate?

Thanks,

Keith

genearlly yes

no - but I'm sure you've already run the numbers as a CPA so that you'd know how to advise your own client

I'd figure it both ways and choose the status that has the lowest tax.

also consider the liability if unpaid.
