My client and his wife had a family trust. He passed away in April 2007. A "family friend" tax planner was going to split the trust and obtained a new FEIN for a bypass trust, which never occured. All income has been reported on surviving spouse's 1040 return for 2007 (all W2's 1099's etc were issued in client or wife's social security numbers). Can I file a zero income/expense 1041 and also make it a final since to cancel the new FEIN assigned to unused, unfunded, no asset trust?

no, you nominee everything (income) off the 1040 that occurred after date of death and put it on the 1041
