Can I use a 2006 1041 for a short tax year in 2007 (1/1/07- on)? I believe they are revising the forms, however,the estate attorney wants the 1041 to the client now. Do I change the 1041 and K-1 to 2007 on the top of the forms if it is allowed?

Hi yes I dont change anything when I do a fiscal year or a final short year. You can show the year end cutoff ex. 10/31, on the face of the return. I would try to get the beginning year 1/1/07 on the face of the return. Your software may not allow it and you may have to use 12/13/06 or change it by hand. The 10/31 cutoff will be reflected on the k-1s and the benes will know to put it on their 1040s for 2007. I wouldnt worry about the form change everything will pass through to the benes due to the final year. bye

but aren't the forms out now? QR, can't you get a 2007 1041 from the IRS website? I already have my 2007 tax software, don't you?>?
