have client that owns real estate personally in his name. Can that person sell his real estate and exchange it for real estate that is owned by an LLC under 1031 rules?

if he is buying the replacement property from the LLC - no problem

if he is exchanging into an interest in the LLC - big problem

would have to be TIC interest

Thanks for info.

What if he was a partial owner (1/3 interest) of the LLC as well? So basically he would have a 1/3 interest in the property being sold by the LLC.
